Report of the House Committee on Public Petitions on the Petition by Hauwa Umar Abore against the Nigeria Police on the Refusal of Nigeria Police, Asokoro Division to Comply with a Senior Magistrate Court’s Order with the Suit No. AB/SMC/OR 231/2012

  1. PREAMBLE
  1. The House of Representatives at its Plenary Sitting of Thursday, 28th September, 2017, received a petition presented by Hon. Danburam Abubakar on behalf of Hauwa umar Abore against the Nigeria Police, Asokoro Division on refusal to comply with a senior Magistrate Court’s order with the Suit No. AB/SMC/OR 231/2012.
  • PETITIONER’S CASE
  • The petitioner, Hauwa Umar Abore informed the Committee that she had a well padded maroon Toyota Camry II car with registration No. BF 494 ABJ.
    • That the car is a clean Toyota Camry year 2000 model engine with a factory fitted A/C, an automatic gear system, a tapping glass, a central opening/closing system, a radio and a compact disk (CD) player.
    • That the car engine was never worked on by any motor mechanic throughout the period she used the car, except the usual routine services.
    • That on 31st March, 2012, she was involved in an accident with her car around NEPA junction, close to A.Y.A with Abuja green Bus.
    • That the two vehicles were towed to Asokoro Division of the Nigeria Police for settlement.
    • That the matter was later charged to court and the trail is ongoing, but the Nigeria Police, Asokoro Division auctioned the car without her knowledge during the tenure of CSP Grace Longe.
    • That on the 15th December, 2016, a senior Magistrate Court sitting at Wuse Zone 2, FCT Abuja, directed the FCT Commissioner of Police to produce the car within Forty Eight (48) Hours, which he refused to comply with the order till date.
    • That the Police asked her to halt the invitation to the House of Representative for hearing on the matter, and consequently both parties agreed through her lawyer, Barr. Paul Ede that she should be paid the sum of Six Hundred Thousand Naira (₦600,000.00) only as the cost of the auctioned vehicle.
    • That on the 6th of October, 2017, the Nigeria Police paid through her lawyer the sum of Four Hundred and Forty Thousand Naira (₦440.000.00) only leaving a balance of One Hundred and Sixty Thousand Naira (₦160,000) only to be paid, but no further action was taken by the Police to pay her the remaining balance.
    • In the light of the above, the petitioner prayed the House to;
  • Recover the remaining balance of One Hundred and Sixty Thousand Naira (₦160,000.00) only from the Nigeria Police, Asokoro Division for her; hence they have refused to obey Court’s order.
  • INVESTIGATIVE HEARING

The Committee conducted investigative hearing on the matter on Thursday, 22nd March, 2018, with both parties in attendance.

  •  RESPONDENT ‘S CASE
  • The Respondent, the Nigeria Police did not make any written submission but admitted in their oral testimonies that the Police should be given two weeks to settle the remaining balance of One Hundred and Sixty thousand Naira (₦160,000.00) only, before the next adjourned date.
  • COMMITTEE FINDINGS
  • Having carefully gone through the submission of the two parties, the following observations were noted by the committee.
    • That the Respondent, Nigeria Police Force during the investigative Hearing informed the committee that the petitioner should come to Finance Building Force Headquarters (FHQ) at Ac. Budget Office for the remaining balance of her One Hundred and Sixty Thousand Naira (₦160.000.00) only after the Investigative Hearing.
  • COMMITTEE RECOMMENDATIONS:
    • Having regards to the findings of the Committee, this is to inform the Honourable House that the Nigeria Police Force has paid the remaining balance of the petitioner’s auctioned car, the sum of One Hundred and Sixty Thousand Naira (₦160,000.00) only on the 7th of May, 2018. Attached is the letter of evidence signed by the petitioner, Hauwa Umar Abore for collection of the remaining balance from the Force Headquarters at AC. Budget Office.
