Report of the Committee on Public Petitions on the Petition by Okugie, Ndukwe Nelson against NIPOST’s Sustained Refusal to Comply with National Assembly’s Resolution to Recall Him to Duty

  1. PREAMBLE
  1. The House of Representatives at its sitting on 1st June, 2017 received a petition to the House by Hon. Bamgbose J. Joseph on behalf of Okugie, Ndukwe Nelson against Nigerian Postal Service blatant refusal to comply with the resolution of the 6th National Assembly to recall him to duty since June, 2009, which was referred to the Committee for further legislative action.
  • PETITIONER’S CASE:
  • Mr Okugie, Ndukwe Nelson petitioned to the 6th National Assembly of the House of Representatives on the 17th of April, 2008,  on his purported retirement by  NIPOST.
  • That the House Committee on Public Petitions considered his position on its merit and invited the two parties for investigative hearing.  Thereafter the Committee’ report was laid before the House and in the Committee of whole, the only recommendation which was approved by the House was that the petitioner should be recalled to the NIPOST services as no case of fraud or embezzlement was established against him.
  • That the House resolution was communicated by the Clerk to the National Assembly (CNA) to the Post-master General for compliance, attaching the Votes and Proceedings of the Sitting of the House held on Tuesday 26th May 2009.
    • That the NIPOST Management has blatantly and obstinately disdained the House resolution without communicating their reasons back to the Clerk to the National Assembly.  This made him to petition to the 7th National Assembly through Hon. Asita   Okorie the second time to ascertain why NIPOST refused to comply with the House resolution.
  • That when the Nigerian Postal Service was invited for hearing by the Committee on Public Petitions in the 7th Assembly, they confirmed receipt of the CNA’s letter of the 6th National Assembly, but gave reasons of administrative lapses, and up till date, they remain adamant.
  • PETITIONER’S PRAYER:
  • The petitioner in his Prayer said that the House of Representatives and indeed the entire National Assembly should prevail upon the NIPOST Management to comply with the 6th Assembly resolution on his case as its corporate life is a product of an Act of Parliament.
  • That following the compliance, all his salaries and allowances be paid to him from August 2000 to date, and
  • That his promotion should be effected to be at par with other colleagues and also show proof of full compliance through the Committee to the National Assembly.
  • INVESTIGATIVE HEARING:
  • The last investigative Hearing on this petition was conducted on Tuesday 13th February, 2018 and both parties were in attendance to give oral and documentary evidence before the Committee.
  • RESPONDENT PRESENTATION:
  • The Respondent, Barr. Bisi Adegbuyi the Post-Master General and his top Management team informed the Committee that NIPOST has agreed to comply with the resolution of the Federal House of Representatives directive to recall Mr Okugie, Ndukwe Nelson, Finance Officer I PN: 92301.
  • That the petitioner upon receipt of his re-instatement letter should report to the Director (Finance and Investment) for deployment.
  • COMMITTEE FINDINGS:
  • The Committee made the following findings during the investigative Hearing:
  • That the Committee in the 6th Assembly recommended that the petitioner should be re-called by NIPOST as no case of fraud of embezzlement was established against him.
  • That Nigerian Postal Services refused to comply with the House resolution of the 6th Assembly which was communicated to the Post Master-General by the Clerk to the National Assembly (CNA), attaching the Votes and Proceeding of the Sitting of the House held on Tuesday 26th May, 2009.
  • That the petitioner did petition to the 7th Assembly over NIPOST refusal to comply with the resolution of the 6th National Assembly.
  • That NIPOST eventually confirmed receipt of the CNA’s letter conveying the House resolution of the 6th Assembly, but gave reasons of administrative lapses.
    • That the petitioner did petition again to the 8th National Assembly over non-compliance with the House resolution of the 6th Assembly by NIPOST the 3rd time requesting the House to compel NIPOST to comply with its previous resolution.
  • That after much pressure to ensure compliance NIPOST agreed to re-instate Mr Okugie, Ndukwe Nelson back to Nigerian Postal Services.

6.0 COMMITTEE RECOMMENDATION:

Having regards to the finding of the Committee, this is to inform the House that NIPOST has re-called Mr Okugie, Ndukwe Nelson to duty on the 13th March, 2018 and has been deployed appropriately.
